Supreme Court Justice Neil Gorsuch rebuked an experienced lawyer during oral arguments on Monday in a matter of focus on discriminating in public schools-a rare and hot exchange that surprised many long court observers.
Tense exchange took place during oral arguments in Ajt’s schools against Osseo, a case focused on whether school districts can be held responsible for discrimination against students with disabilities under the 1990s and rehabilitation act of 1973.
Gorsuch rebuked Williams & Connolly lawyer Lisa Blatt, an experienced judge of the Supreme Court representing Minnesota Public Schools on charges of “lies” plaintiffs in their allegations before the Supreme Court.
The plaintiffs in this case are representing the parents of a girl of serious epilepsy who sued the public school for refusing to secure the school at home during the morning, an accommodation she would get to other districts of the state.
The exchange between Gorsuch and Blatt took place after she accused them of being lied to the public school’s stay.
The adviser “should be more careful with their words,” Gorsuch Blatt told a warning.
“Well, they need to be more careful in the misconception of a position from an experienced lawyer of the Supreme Court, with all the proper respect,” Blatt replied.
Later, he again referred to the accusation of lying. “Mrs. Blatt,” Gorsuch told her, “I confess that I am still worried about your suggestion that your friends on the other side have lied.”
“Okay,” she fired. “Let’s pull it. In oral arguments …”
Gorsuch cut off, saying, “I think it will need, here. And I would ask you to reconsider that phrase.”
“You can accuse people of being incorrect, but lies -” Gorsuch said, before Blatt try to intervene.
“Mrs. Blatt, if I can end,” Gorsuch said, before she continues: “But lie is another matter.”
He then began reading through the page one of their cuts, before it is interrupted again.
“I haven’t finished,” Gorsuch told, raising the voice.
“Withdraw your charge, Mrs. Blatt,” he then told her about the accusation of lying.
“Fine, I withdraw,” she shot again.
The plaintiffs said in opposition only that they would not dignify the call of the name.
The exchange sparked some online buzzing, including an experienced judge of the Court of Appeal, Raffi Melconian, who pointed to the exchange on social media, “I have never heard of justice so angry.”
